This law is the transposition of the '<i>European Directive 2019\/1937 on the protection of persons reporting breaches of Union law<\/i>' under Belgian law.<\/p><p>A so-called \"whistleblower\" brings violations\/misconduct within a company to light. Until recently, these persons were not or insufficiently protected. Therefore, the European Union now obliges the <b>enshrine protection of whistleblowers in legislation<\/b>. This should lower the threshold for employees to raise violations without fear of reprisal.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b5410f1 elementor-widget elementor-widget-heading\" data-id=\"b5410f1\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">Scope<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-734f879 elementor-widget elementor-widget-text-editor\" data-id=\"734f879\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-style: inherit; font-weight: inherit; background-color: var(--ast-global-color-5);\">The European Whistleblowing Directive is <\/span><span style=\"font-style: inherit; background-color: var(--ast-global-color-5);\"><b>applicable to the <\/b><\/span><span style=\"font-style: inherit; background-color: var(--ast-global-color-5);\"><b>entire private and public sector<\/b>.<\/span> <span style=\"font-style: inherit; font-weight: inherit; background-color: var(--ast-global-color-5);\">Self-employed persons, managerial staff, directors, trainees, applicants, volunteers, former employees, (sub)contractors and suppliers also fall within the scope of this law. It also protects confidants and other third parties (such as family members, colleagues or friends) who assist a whistleblower. For the public and private sectors, the Belgian legislator has provided two separate pieces of legislation.<\/span><\/p><p>The whistleblower enjoys protection from retaliation only if he or she reports violations of subsequent legislation:<\/p><ul><li>government contracts;<\/li><li>financial services, products and markets, prevention of money laundering and terrorist financing;<\/li><li>product safety and product compliance;<\/li><li>transport safety;<\/li><li>environmental protection;<\/li><li>radiation protection and nuclear safety;<\/li><li>food and feed safety, animal health and animal welfare;<\/li><li>public health;<\/li><li>consumer protection;<\/li><li>protection of privacy and personal data, and security of network and information systems;<\/li><li>combating tax fraud;<\/li><li>social fraud prevention;<\/li><li>the financial interests of the European Union;<\/li><li>Infringements related to the European single market.<\/li><\/ul><p>By \"retaliation,\" the legislature means harassment, discrimination, demotion, deprivation of training or promotion, negative evaluation, (reputational) damage suspension or dismissal.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ddc7a25 elementor-widget elementor-widget-heading\" data-id=\"ddc7a25\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">What is expected of me?<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5aca5cf elementor-widget elementor-widget-text-editor\" data-id=\"5aca5cf\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The obligations resulting from this law depend on the size of the company. Below is a summary of obligations based on size:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ba5e649 elementor-widget elementor-widget-text-editor\" data-id=\"ba5e649\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<table>\n<tbody>\n<tr>\n<td style=\"background-color: #0f1547; color: white;\">&lt; 50 employees<\/td>\n<td>There must be a reporting channel, but does not have to be internal. So this may also be a <b>internal or external platform <\/b>are.<\/td>\n<\/tr>\n<tr>\n<td style=\"background-color: #0f1547; color: white;\">\u2265 50 employees <br>&lt; 250 employees<\/td>\n<td>There must be a\u00a0<span style=\"font-weight: bold;\">inte<\/span><b>rn notification platform<\/b> be and this should <u>as of December 17, 2023<\/u> take effect.<\/td>\n<\/tr>\n<tr>\n<td style=\"background-color: #0f1547; color: white;\">\u2265 250 employees<\/td>\n<td>There should be <u>as of February 15, 2023<\/u> a\u00a0<span style=\"font-weight: bold;\">internal<\/span><b>\u00a0notification platform<\/b> in operation. These notifications must <b>also\u00a0<\/b><span style=\"font-weight: bold;\">anonymous<\/span>\u00a0can happen.<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-43d0512 elementor-widget elementor-widget-text-editor\" data-id=\"43d0512\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The <b>reporting channel <\/b>must comply with various requirements (including security, confidentiality, information, diligence and impartiality) and procedural rules.<\/p><p>However, the legislature has also <b>external reporting channels<\/b> provided. Examples include the <b>NIHDI<\/b>, <b>RVA<\/b>, <b>FIRM <\/b>(Central Information Point on Whistleblower Laws), <b>NSSO <\/b>and <b>SOID<\/b>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b436b1b elementor-widget elementor-widget-heading\" data-id=\"b436b1b\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h4 class=\"elementor-heading-title elementor-size-default\">Procedure<\/h4>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-056480f elementor-widget elementor-widget-text-editor\" data-id=\"056480f\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-style: inherit; font-weight: inherit; background-color: var(--ast-global-color-5);\">The Whistleblower Directive requires organizations to develop a procedure regarding the (internal) reporting and follow-up of breaches.<\/span><\/p><ul><li>Whistleblowers should be the <b>notify established violation in writing or orally<\/b>. Communication channels should be mentioned in the procedure. These channels should ensure the anonymity of the whistleblower (250 employees or more) and the confidentiality of the report. All reports are kept by the organization in a <b>register<\/b>.<\/li><li>Enterprises must have a <b>designate impartial person or department<\/b> who is responsible for following up on reports within specified timeframes.<\/li><li>The whistleblower must <b>within seven days an acknowledgment of receipt<\/b> receive. This will also include who will handle the report further and maintain communication with the whistleblower.<\/li><li>There should be <b>feedback <\/b>be given on the notification <b>within a period of three months<\/b>.<\/li><li>Information should be included in the procedure regarding external reports.<\/li><\/ul><p>Whistleblowers can also use <b>external reporting channels<\/b>. For the whistleblower, nothing changes regarding the follow-up of the report.<\/p><p>The whistleblower can also make the information public under certain conditions.
